General Terms and Conditions

1. Scope

These Terms and Conditions apply to contracts for goods concluded through drbildirmedical.com with Dr. BILDIR Medical GmbH.

A consumer is a person acting primarily for purposes outside their trade, business or profession (section 13 BGB). An entrepreneur is a person acting in the course of their trade, business or profession (section 14 BGB).

Approved partners are additionally subject to the partner terms displayed in their account or agreed individually. Different customer terms apply only where expressly accepted by us.

2. Conclusion of contract

Product displays in the online shop are not binding offers. By submitting an order, you make a binding offer to purchase the products in the cart.

The automatic acknowledgement documents receipt of the order but does not constitute acceptance unless expressly identified as an order confirmation. We may accept your offer within five days by express confirmation, shipping confirmation, delivery or – depending on the payment method – execution or request of payment. If the offer is not accepted, any amount already collected will be refunded without undue delay.

Before submitting the order, you can correct input errors using the functions provided in the shop.

3. Prices, shipping costs and payment

The prices, taxes, shipping costs and payment methods displayed in the cart and at checkout before you place the order are decisive.

Consumer prices include statutory VAT. A different, clearly labelled price display may apply to approved partners.

Payment is made using a method offered at checkout. Payment providers may apply their own terms and checks. Individually agreed partner terms remain unaffected.

4. Delivery

We currently deliver exclusively within Germany to the delivery address provided by you. Delivery time and shipping costs are displayed before the order is submitted.

For consumers, the risk of accidental loss or damage generally passes only when the goods are handed over. For entrepreneurs, the statutory rules, including those on shipment purchases, apply.

Partial deliveries are permitted where reasonable and where they do not result in additional shipping costs for you.

If a product is unavailable, we will inform you without undue delay. Amounts paid for goods that are not delivered will be refunded without undue delay.

5. Retention of title

Goods remain our property until paid for in full.

6. Statutory rights in the event of defects and liability

Statutory rights in the event of defects apply. Consumers are asked to report visible transport damage promptly; delayed reporting does not restrict statutory rights. Section 377 of the German Commercial Code (HGB) applies to merchants.

We have unlimited liability for intent and gross negligence, injury to life, body or health, under the German Product Liability Act and to the extent that we have assumed a guarantee.

For a slightly negligent breach of an essential contractual obligation, liability is limited to foreseeable damage typical of the contract. Liability for other slight negligence is excluded. Mandatory statutory liability remains unaffected.

7. Voluntary 30-day money-back guarantee

In addition to statutory rights, we grant consumers a voluntary 30-day money-back guarantee for all physical products purchased through drbildirmedical.com. It runs from receipt and also covers products that have been opened and reasonably tried.

The return must be registered within the 30-day period by e-mailing info@drbildirmedical.com and stating the order number and products concerned. We provide return instructions and a prepaid DHL return label. After receiving the goods, we generally refund the purchase price of the returned products using the same payment method.

The guarantor is Dr. BILDIR Medical GmbH, Glücksteinallee 69, 68163 Mannheim, Germany. The guarantee applies to deliveries to consumers in Germany. It applies to entrepreneurs only where expressly agreed.

Statutory rights in the event of defects and the statutory right of withdrawal are available independently, are free of charge and are not restricted by the guarantee. The full guarantee terms are set out in the Right of Withdrawal Instructions.

8. Statutory right of withdrawal for consumers

Consumers generally have a statutory right of withdrawal. The conditions, periods, effects, exceptions, electronic withdrawal function and model withdrawal form are set out in our Right of Withdrawal Instructions.

The statutory right may expire for sealed goods that are not suitable for return for reasons of health protection or hygiene if the seal is removed after delivery. The voluntary 30-day money-back guarantee under section 7 remains independent.

9. Customer account, Skin Lab, Academy and partner access

Guest orders are available. A customer account may also be created independently of an order, in particular for Skin Lab and for Academy and partner functions.

You must protect your login details appropriately and inform us promptly of suspected misuse. You may request account deletion at any time; statutory retention duties and legitimate grounds for retaining individual data remain unaffected.

A customer account does not automatically activate partner terms. Partner access is activated only after separate review and approval of the partner organisation.

10. Promotional codes and vouchers

Promotional codes and vouchers are subject to the terms stated when they are issued. Cash redemption is excluded unless mandatory law requires otherwise.

11. Privacy

Information about our processing of personal data is available in our Privacy Policy.

12. Consumer dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

13. Contract text and languages

The contract languages are German and English. Order data and the legal texts applicable when the contract is concluded are stored within the statutory and technical framework and provided with the order confirmation or on a durable medium. You may save or print the legal texts before ordering.

14. Governing law and jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of a consumer’s country of habitual residence remain unaffected.

Where legally permitted, Mannheim is the place of jurisdiction for merchants, public-law entities and special funds under public law.

If a provision is ineffective, the remaining provisions remain effective and statutory law applies in place of the ineffective provision.
